These Terms and Conditions of Sale (hereinafter "Terms") govern the sale of products offered on the website www.beseas.com by the company Beseas.
Any order placed on the website implies unreserved acceptance of these Terms.
ARTICLE 1 - PURPOSE
These Terms and Conditions of Sale (hereinafter "Terms") govern the sale of products offered on the website www.beseas.com by the company Beseas.

ARTICLE 2 - SCOPE
These Terms define the rights and obligations of the parties in the context of the online sale of new sports equipment offered by Beseas to consumers and professionals.
ARTICLE 3 - PRODUCTS
3.1 Product Description
Beseas offers new sports equipment for sale. Products are described and presented as accurately as possible on the website www.beseas.com.
The photographs and visuals presented are non-contractual and may differ slightly from the actual product, particularly due to your screen display settings. However, Beseas commits to ensuring that delivered products conform to the descriptions provided.
3.2 Availability
Products are offered subject to available stock. If a product becomes unavailable after an order has been placed, the customer will be informed as soon as possible by email. The customer will then have the choice between:
- Cancellation of the order with full refund
- Replacement with an equivalent product (subject to customer acceptance)
ARTICLE 4 - PRICES
4.1 Product Prices
Product prices are indicated in euros, including all taxes (VAT included), based on the VAT rate applicable on the day of the order.
The displayed prices include shipping and delivery costs. No additional fees will be added to the order amount.
4.2 Customs Duties
Deliveries are made on a DDP (Delivered Duty Paid) basis. Beseas covers all customs duties, import taxes, and applicable VAT for all destinations (France, European Union, and rest of the world).
The customer will have no additional fees to pay upon delivery.
4.3 Price Changes
Beseas reserves the right to modify its prices at any time. Products are invoiced based on the prices in effect at the time of order validation, subject to availability.
4.4 Promotions and Promo Codes
Promotions and promotional codes may be offered periodically. Usage conditions are specified during each promotional operation.
ARTICLE 5 - ORDERING
5.1 Ordering Process
To place an order, the customer must:
- Select products and add them to the cart
- Review the cart contents
- Enter delivery and billing information
- Choose the payment method
- Review all information
- Accept these Terms by checking the designated box
- Confirm and validate the order by proceeding to payment
5.2 Available Languages
The ordering process is available in French, English, and German.
5.3 Order Confirmation
Once the order is validated and payment accepted, a confirmation email is automatically sent to the customer at the email address provided during the order. This email includes:
- Order number
- Ordered products
- Total amount
- Delivery address
- Billing information
The sale is considered final upon receipt of payment and sending of the confirmation email.
5.4 Minimum Amount
No minimum order amount is required.
5.5 Order Modification or Cancellation
Once the order is confirmed and payment made, it is no longer possible to modify or cancel it, except by exercising the right of withdrawal under the conditions set forth in Article 8.
ARTICLE 6 - PAYMENT
6.1 Payment Methods
Beseas accepts the following payment methods:
- Credit cards (Visa, Mastercard, American Express, etc.)
- Shop Pay
- PayPal
Payments are securely processed by Shopify Payments.
6.2 Installment Payments
Unless explicitly stated otherwise during the ordering process, payment is made in full in one installment.
6.3 Payment Security
All banking transactions are secured by SSL protocol and 3D Secure system when activated by the customer's bank. Banking data is neither collected nor stored by Beseas. It is directly transmitted in encrypted form to our PCI-DSS certified payment processor.
6.4 Time of Charge
The customer's bank account is charged at the time of order validation.
6.5 Payment Failure
In case of payment refusal or failure, the order will not be validated and no product will be shipped.
ARTICLE 7 - DELIVERY
7.1 Delivery Zones
Beseas delivers worldwide:
- Metropolitan France and French overseas territories
- European Union
- Rest of the world
7.2 Delivery Times
Processing time: Orders are processed and shipped within 24 business hours following order and payment validation.
Delivery times: Delivery times are 8 to 15 business days from shipment, for all destinations (France, European Union, International). These times are indicated for informational purposes on each product page.
Times may vary depending on destination and shipping conditions. Beseas cannot be held responsible for delivery delays due to the carrier or events beyond its control.
7.3 Delivery Methods
Delivery is made to the address indicated by the customer when ordering. It is imperative that this address be accurate and complete.
In case of recipient absence: If the customer is absent during the delivery attempt, the carrier will leave a notice. The package will then be held according to the procedures in effect at the postal center in the delivery country (generally at a post office or relay point). The customer has a variable time period depending on the country to collect their package before it is returned to the sender.
7.4 Verification Upon Receipt
The customer is invited to check the condition of the package upon receipt. In case of damaged, opened, or incomplete package, the customer must:
- Refuse the package or make written reservations to the carrier
- Notify Beseas within 48 hours by email at contact@beseas.com with supporting photos
7.5 Delivery Failure
In case of non-delivery within the announced times, the customer must contact Beseas at contact@beseas.com. A search will be conducted with the carrier.
If the package is definitively lost or if delivery cannot be made for a reason attributable to Beseas, a full refund or product reshipping will be offered to the customer.
ARTICLE 8 - RIGHT OF WITHDRAWAL (CONSUMER CUSTOMERS)
In accordance with articles L221-18 et seq. of the Consumer Code, consumer customers (natural persons acting for non-professional purposes) have a 14-day period to exercise their right of withdrawal without having to justify reasons or pay penalties.
8.1 Withdrawal Period
The withdrawal period expires 14 days after the day on which the customer, or a third party other than the carrier designated by the customer, physically takes possession of the goods.
8.2 Exercising the Right of Withdrawal
To exercise the right of withdrawal, the customer must notify their decision to withdraw by means of an unambiguous statement, by email to: contact@beseas.com
8.3 Effects of Withdrawal
In case of withdrawal, Beseas commits to refunding all sums paid by the customer, including initial delivery costs (except for additional costs resulting from the choice of a delivery method other than the standard method offered).
The refund will be made within a maximum period of 14 days from the day on which Beseas was informed of the withdrawal decision, and after receipt of returned products or after receipt of proof of shipment of products.
The refund will be made using the same payment method used for the initial transaction, unless express agreement by the customer for another payment method.
8.4 Product Returns
The customer has a period of 14 days from notification of withdrawal to return the products.

Return costs: Return costs are borne by the customer.
Product condition: Products must be returned in their original packaging, in perfect resale condition (new, unworn, unused, unwashed), with all accessories, instructions, and labels.
The customer is responsible for depreciation of goods resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of these goods.
8.5 Exceptions to the Right of Withdrawal
In accordance with article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for the following products:
- Masks and glasses with prescription lenses (products manufactured according to customer specifications or clearly personalized)
8.6 Non-Application to Professionals
The right of withdrawal does not apply to professional customers who do not benefit from the provisions of the Consumer Code.
ARTICLE 9 - LEGAL GUARANTEES
Products sold by Beseas benefit from the following legal guarantees:
9.1 Legal Guarantee of Conformity
In accordance with articles L217-4 to L217-14 of the Consumer Code, consumer customers benefit from a legal guarantee of conformity for 2 years from delivery of the goods.
During this period, the customer may request:
- Repair or replacement of the goods (at the seller's choice)
- Failing that, price reduction or contract resolution (return of goods against refund)
Presumption of non-conformity: Any conformity defect noted within 24 months of goods delivery is presumed to exist at the time of delivery, unless proven otherwise.
The customer may choose between repair or replacement of the goods, subject to cost conditions provided for by article L217-9 of the Consumer Code.
The customer is dispensed from providing proof of the existence of the conformity defect of the goods during the 24 months following goods delivery.
Important: The legal guarantee of conformity applies independently of any commercial guarantee possibly granted.
9.2 Guarantee Against Hidden Defects
In accordance with articles 1641 to 1649 of the Civil Code, the customer may also implement the guarantee against hidden defects of the thing sold.
In this case, the customer may choose between:
- Sale resolution (return of goods against price refund)
- Sale price reduction
Time limit: Action must be brought within 2 years from discovery of the defect.
9.3 Implementation of Guarantees

Beseas commits to responding within 48 business hours.
Return of defective products: In case of conformity defect or hidden defect, return costs for the defective product are borne by Beseas. A prepaid return label will be provided to the customer.
9.4 Excerpts from Legal Texts
Article L217-4 of the Consumer Code:
"The seller delivers goods conforming to the contract and is liable for conformity defects existing at delivery. The seller is also liable for conformity defects resulting from packaging, assembly instructions, or installation when this has been charged to the seller by the contract or has been carried out under the seller's responsibility."
Article L217-5 of the Consumer Code:
"The goods conform to the contract:
1° If suitable for the use usually expected of similar goods and, where applicable:
- if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model;
- if it has the qualities that a buyer can legitimately expect given the public declarations made by the seller, producer, or their representative, particularly in advertising or labeling;
2° Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the seller's attention and that the seller has accepted."
Article L217-12 of the Consumer Code:
"Action resulting from conformity defect is prescribed two years from goods delivery."
Article 1641 of the Civil Code:
"The seller is bound to guarantee against hidden defects of the thing sold that make it unfit for the use for which it is intended, or that so diminish this use that the buyer would not have acquired it, or would have given only a lesser price, had they known them."
Article 1648 paragraph 1 of the Civil Code:
"Action resulting from redhibitory defects must be brought by the purchaser within two years from discovery of the defect."
ARTICLE 10 - LIABILITY
10.1 Limitation of Liability
Beseas cannot be held liable for:
- Indirect, intangible, or consequential damages (such as loss of profits, loss of chance, commercial prejudice, loss of clientele, etc.)
- Delays or non-performance due to force majeure as defined by French case law
- Non-performance or poor performance of contractual obligations attributable to the customer (incorrect address, absence during delivery, etc.)
- Non-compliant use of products by the customer
10.2 Force Majeure
Beseas cannot be held liable in case of force majeure or circumstances beyond its reasonable control, such as notably:
- Natural disasters
- Fires, floods
- Total or partial strikes
- War, riots
- Epidemics or pandemics
- Interruption of telecommunications or electrical network
- Failure or blockage of means of transport or supply
In case of occurrence of a force majeure event, Beseas will inform the customer as soon as possible and will strive to minimize consequences.
If the force majeure event persists beyond a period of 30 days, the customer may request order cancellation and refund of sums paid.
ARTICLE 11 - INTELLECTUAL PROPERTY
All elements of the website www.beseas.com (texts, images, photographs, logos, trademarks, videos, sounds, plans, databases, software, etc.) are the exclusive property of Beseas or are subject to usage authorization.
Any reproduction, representation, modification, publication, adaptation, total or partial, of site elements, whatever the means or process used, is prohibited, except prior written authorization from Beseas.
Any unauthorized exploitation of the site or any of the elements it contains will be considered as constituting counterfeiting and prosecuted in accordance with the provisions of the Intellectual Property Code.
ARTICLE 12 - PERSONAL DATA
Personal data collected during ordering is subject to computer processing intended for order management, customer relations, and, where applicable, sending marketing communications.

13.2 Consumer Mediation
In accordance with articles L611-1 et seq. of the Consumer Code, in case of dispute with a consumer customer that could not be resolved amicably, the customer may resort free of charge to a consumer mediator.

13.3 Legal Action
Resort to mediation is optional and does not deprive the customer of their right to take legal action.
ARTICLE 14 - APPLICABLE LAW AND JURISDICTION
14.1 Applicable Law
These Terms are governed by French law.
The language of these Terms is French. In case of translation into one or more languages, only the French text shall prevail in case of dispute.
14.2 Competent Jurisdiction
For consumer customers:
In case of dispute, and after failure of any attempt to seek an amicable solution or mediation, French courts shall have sole jurisdiction. The customer may choose:
- The court of the place where they resided at the time of contract conclusion or occurrence of the harmful event
- The court of the location of the seller's establishment (Libourne)
For professional customers:
Any dispute relating to the interpretation or execution of these Terms shall be subject to the exclusive jurisdiction of the Commercial Court of Libourne, unless otherwise required by mandatory legal provision.
14.3 Customers Outside the European Union
For customers located outside the European Union, these Terms are governed by French law. However, mandatory provisions of consumer protection laws applicable in the customer's country of residence may prevail when these are of mandatory application.
In case of conflict between a provision of these Terms and a mandatory local law, the local law shall apply to the extent required by it.
ARTICLE 15 - ACCEPTANCE OF TERMS
Placing an order implies full and unreserved acceptance by the customer of these Terms. The customer acknowledges having read these Terms and having accepted them before placing their order.
The customer also acknowledges having the required capacity to contract and acquire products offered on the website www.beseas.com.
ARTICLE 16 - MODIFICATIONS TO TERMS
Beseas reserves the right to modify these Terms at any time. The applicable Terms are those in effect on the date of the order.
Modifications will not affect orders already confirmed.
ARTICLE 17 - SEVERABILITY
If one or more provisions of these Terms are held invalid or declared as such pursuant to a law, regulation, or following a final decision by a competent court, the other provisions shall retain all their force and scope.
ARTICLE 18 - RETENTION OF TERMS
These Terms may be consulted at any time on the website www.beseas.com.
In accordance with current regulations, Beseas archives these Terms and retains proof of the contract concluded with the customer for a period of 10 years from product delivery.
